How You Can Hurt Your Case

 

 

If you are truthful, honest and sincere in all aspects of your particular case and cooperate fully with the advice and recommendations of your attorney, there will be few ways that you will hurt or damage your case. We will attempt to provide you with some of the elements that could damage your case so that you will avoid hurting your case.

 

1. Make sure you tell your attorney of all prior accidents or injuries you have been involved in or sustained. Police records can easily be obtained reflecting other accidents, even the most minor fender benders, and the insurance company also has an index system on a nationwide basis that shows all people who have made claims for injuries. If you have ever brought a claim for injury or incident, your name will be there.

 

2. Do not discuss your case with anyone other than your lawyer. Any problems or dissatisfaction you have with your doctor should never be discussed with anyone else. Do not in your own mind try to determine what may or may not be important in your particular case. Always ask your attorney; that is why they are retained.

 

3. If at any time you are required to fill out an application which includes your responding to questions pertaining to your physical condition, health, disability, physical limitations, etc., you must complete this information accurately and truthfully even if it means you are rejected for whatever purpose you are submitting the application. The defense will, in all probability, obtain all applications of this type and responses minimizing your injury will only hurt your case.
